1. Scope
(1) The following terms and conditions apply to all business relations between the ENERMED UK LTD ("ENERMED") and the customer in the current version at the time of the order. The use of other general terms and conditions of business, especially contrary or crossing general terms and conditions is hereby expressly contradicted.
(2) ENERMED operates a homepage under the domain for commercial purposes and offers customers products, especially from the fields of medical technology, for purchase via the Internet.
(3) These terms and conditions also apply to all future transactions between ENERMED and the customer.
2. Contracting Party
(1) The contract of sale is concluded with ENERMED. Further information about the company can be found in the imprint.

3. Conclusion of Contract
The following provisions on the conclusion of the contract apply to orders via our internet shop. The internet shop is available via the URL https://www.neuroces.co.uk/category/all-products. The language available for the conclusion of the contract via the website is exclusively English.
(1) The presentation of the products in the internet shop does not constitute a legally binding offer, but only a non-binding online product range. Offers are not binding, but only invitation to offer (invitatio ad offerendum).
(2) Your order constitutes an offer to conclude a purchase contract. You can cancel the order process or correct your details at any time until the final dispatch of your order. Any input errors in the submission of your order can be corrected via the input screens in the website using a deletion and change function before sending the order. Your order is binding after pressing the button“Place Order & Pay”.
(3) After you have placed the order by pressing the button “Place Order & Pay”, we will send you an e-mail confirming receipt of your order. This e-mail informs you exclusively about the receipt of the order and thus does not constitute a confirmation of acceptance of your offer (confirmation of receipt). A contract of sale between you and ENERMED only comes about when the readiness to ship the ordered goods is confirmed to you by a second e-mail (confirmation of purchase) or the ordered goods are sent to you. Products that are not listed in the purchase confirmation or that are not included in the delivery will not be sold.
(4) The essential characteristics, properties and other characteristics of the goods offered can be found in the individual product descriptions on the website.
(5) Offers are valid only while the good are available in stocks. ENERMED sells all goods in principle only in household quantities. We reserve the right not to execute the order in case of unavailability of the goods.
5. Prices
All prices are gross prices and are in GBP. The prices shown include statutory value added tax and other price components. In addition, any shipping costs, small quantity surcharges and, if applicable, the costs of shipping by cash on delivery.
4. Withdrawal
4.1. Cancellation
You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you, who is not a carrier, have taken possession of the goods.

by means of a clear statement (such as a letter sent by post or e-mail) of your decision to withdraw from this contract. You can use the downloadable model withdrawal form, but this is not mandatory.
To maintain the cancellation period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
4.2. Consequences of the Cancellation
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
4.3. Exclusion of the Right of Withdrawal
Unless otherwise agreed by the parties, the right of withdrawal shall not apply to contracts for the supply of sealed goods which, for reasons of health or hygiene, are not suitable for return if their seal has been removed after delivery, or to contracts for the supply of goods which are not prefabricated and the manufacture of which is determined by an individual choice or specification by the consumer or which are clearly tailored to the personal needs of the customer.

6. Payment Options
Payment can be made either in advance, cash on collection, by credit card, Stipe or on account.
(1) If you choose to pay in advance, you transfer the invoice amount to our bank account. We will inform you of the bank details in the order confirmation. The goods will be delivered/shipped after receipt of payment.
(2) A cash payment is only possible with personal pickup.

(3) Your credit card will be charged upon completion of the order.
(4) If you select the payment method Stripe, you pay the invoice amount via the online provider Stripe. You must always be registered there or register first, legitimize yourself with your access data and confirm the payment instruction to us. The optional guest account with Stripe is an exception. You will receive further information during the ordering process.
(5) We reserve the right to exclude individual payment methods.
7. Shipping Costs, Delivery
(1) For orders over 100 GBP, shipping is free of charge. For orders under 100 GBP, you pay a flat shipping fee of 3.5 GBP.
(2) Should a shipment be made in several stages for technical or logistical reasons, we shall charge the shipping fees only once.
(3) Delivery is usually made by UPS or another suitable service provider.
(4) Deliveries are made within the United Kingdom only

(6) Pickup of the goods is possible after prior consultation.
(7) Delivery to packing stations is only possible after prior consultation.
(8) If there is a delay in delivery or a delivery bottleneck, you will be informed immediately.
8. Retention of Title
(1) The delivered goods shall remain the property of ENERMED (reserved goods) until full payment of all claims including ancillary claims. The buyer may not dispose of the reserved goods.
(2) In the event of access by third parties, in particular bailiffs, to the goods subject to retention of title, the buyer must point out the existing rights of ENERMED and notify them immediately. Costs and damages shall be borne by the Buyer. In case of breach of contract ENERMED is entitled to take back the reserved goods at your expense. The withdrawal and attachment of the reserved goods by ENERMED shall not constitute a withdrawal from the contract.
9. Transportation Damages
If goods are delivered with obvious transport damage, please report such defects to the delivery company as soon as possible and contact us immediately. Missing a complaint or contact has no consequences for you. However, they help us to assert our own claims against the carrier or the transport insurance company.
10. Statutory Liability for Defects
The NeuroCes™ PWL-05 Cranial Electrotherapy Stimulator is warranted against defects in design, assembly, materials and workmanship for a period of 2 years from the date of receipt ("Warranty").
This Warranty is valid only for the original purchaser of the NeuroCes™ PWL-05 Cranial Electrotherapy Stimulator (Device). ENERMED warrants to the original purchaser of NeuroCes™ PWL-05 Cranial Electrotherapy Stimulator device for a period of 2 years, that the Device shall be free of defects in design, assembly, material, and workmanship. ENERMED will repair or replace, at its option, any defective Device for the original purchaser free of charge.
This Limited Warranty covers its products purchased in original product packaging from ENERMED.
This warranty ceases if the product has been damaged by accident, in shipment, unreasonable use, misuse, neglect, improper service, commercial use, repair by unauthorized personnel or cause not arising out of defect in materials or workmanship.
To obtain warranty service, the customer must return the NeuroCes™ (shipping charges pre-paid) to ENERMED with a written explanation of the claim. To obtain warranty service, the device must be received within 2 years from date of receive.
Your claims for damages, regardless of the legal reason, as well as your claims for compensation for futile expenses are excluded.
This does not apply if the cause of damage is based on grossly negligent or intentional breach of duty or on an at least negligent breach of essential contractual obligations (cardinal obligations); in the case of negligent breach of essential contractual obligations, the liability shall be limited in amount to the typically foreseeable damage. Furthermore, this shall not apply to damages arising from injury to life, body or health, in the event of liability under the Product Liability or to the extent that ENERMED has fraudulently concealed a defect or has exceptionally assumed a guarantee.

11. Contract Language
The language available for the conclusion of the contract is English.
12. Severability Clause
Should any provision of this Agreement be or become ineffective or countervailable for any reason, the remaining provisions shall remain unaffected by this. The contract shall, where appropriate, be interpreted or supplemented in such a way that the parties want to do so is achieved as far as possible.
